1. Acceptance of Terms

By renting a vehicle, using our website, or making a payment through our online systems (including Stripe), you agree to these Terms of Service (“Terms”).
These Terms form a legally binding agreement between you (“Hirer” or “Customer”) and Olive Tree Car Rental L.L.C S.O.C (“Olive Tree,” “we,” “our,” or “us”).

2. Services Olive Tree provides short- and long-term vehicle rental services within the UAE. All rentals are governed by a signed Vehicle Rental Agreement (“Rental Agreement”), which specifies the rental period, rates, security deposit, authorised drivers, and applicable terms. The Rental Agreement prevails in the event of any conflict with these Terms.

This Vehicle Rental Agreement (“Agreement”) is entered into by and between:

1. Olive Tree Car Rental L.L.C S.O.C, a limited liability company duly incorporated under the laws of the United Arab Emirates, holding Trade Licence No. 1546848, and having its registered office at Office No. 6, I-SH-444, Dubai Industrial City, Saih Shuaib 2, Dubai, United Arab Emirates (hereinafter referred to as the “Owner”);

AND

2. The individual or entity whose details are set out in the Rental Form (hereinafter referred to as the “Hirer”).

The Owner and the Hirer are hereinafter collectively referred to as the “Parties” and individually as a “Party”.

 

Article 1 – Definitions

For the purposes of this Agreement:

• “Vehicle” means the motor vehicle rented by the Owner to the Hirer under this Agreement.
   

• “Rental Period” means the duration agreed between the Parties for which the Vehicle is rented.
   

• “Deposit” means the security deposit held or blocked on the Hirer’s credit card or paid in cash in accordance with this Agreement.
   

 

2 – Eligibility and Authorised Drivers

2.1 Minimum Age
The Hirer and any authorised driver must be at least twenty-five (25) years of age. Drivers aged between twenty-one (21) and twenty-four (24) may be accepted at the Owner’s discretion; however, an additional insurance excess of fifteen percent (15 %) of total repair costs shall apply per incident.

2.2 Licence (UAE Residents)
UAE residents must hold a valid UAE driving licence issued at least twelve (12) months prior to the commencement of the Rental Period.

2.3 Licence (Visitors)
Visitors must present:

• a valid International Driving Permit (IDP); and
   

• a valid national driving licence issued at least twelve (12) months prior to the rental date.
   

However, where the visitor’s national licence is issued by a country recognised by UAE authorities as exempt from the IDP requirement, the Owner may, at its sole discretion, accept the national licence alone.
The Hirer acknowledges that in the absence of a valid IDP, insurance cover may be void under the insurer’s terms, and all liability for resulting losses or claims shall rest with the Hirer. 

2.4 Authorised Drivers
Only the Hirer and those drivers specifically authorised and listed in this Agreement may operate the Vehicle. An additional charge per day applies for each additional authorised driver.

 

Article 3 – Permitted Use of the Vehicle

3.1 The Vehicle shall be used solely for lawful personal or business transportation within UAE territory.
3.2 The Vehicle shall not be used for: racing, off-road or desert driving, towing, rallying, carriage of passengers or goods for hire, driving through water, or any other hazardous or unlawful purpose.
3.3 The Hirer shall not sub-lease, assign, or otherwise part with possession of the Vehicle.

 

Article 4 – Rental Fees and Payment Terms

4.1 All rental charges are payable in advance, daily, monthly or quarterly as agreed in writing.
4.2 The Hirer authorises the Owner to block an amount on the Hirer’s credit card to secure payment obligations under this Agreement.
4.3 If payment is delayed or fails, the Owner may remotely disable the Vehicle, repossess it, and charge AED 100 per day as a late-payment penalty.
4.4 Rental fees are non-refundable; early termination by the Hirer shall not entitle them to any refund.
4.5 Cancellation of booked Vehicle more than 7 days from start date – full refund; within 1-7 days – 50% refund; less than 24 hours – no refund. 

 

Article 5 – Insurance and Liability

5.1 Coverage. The Vehicle is insured in accordance with UAE law. Coverage is subject to the terms and exclusions of the Owner’s insurance policy (Adamjee Insurance).

5.2 Exclusions. Insurance does not apply in the following cases:
(a) Use of the Vehicle in breach of Article 3;
(b) Operation under the influence of alcohol, drugs, or controlled substances;
(c) Driving without a valid licence, or with an expired, suspended, or unrecognised licence;
(d) Overloading or exceeding passenger capacity;
(e) Tyre-only damage unrelated to an accident;
(f) Natural disasters, riots, terrorism, or war;
(g) Use of the Vehicle outside the UAE.

5.3 Excess. The Hirer shall pay AED 1 500 per incident if at fault.

5.4 Young Drivers. Drivers aged 21–24 years shall bear an additional 15 % charge of the repair costs.

5.5 Police Report. If a police report acceptable to the authorities is not obtained, insurance will be void and the Hirer bears full liability for damage, third-party claims, and loss of use.

5.6 Optional CDW. Hirer may purchase Collision Damage Waiver (CDW) at a daily, weekly or monthly basis.

 

Article 6 – Hirer Obligations

6.1 Comply with all UAE traffic and municipal laws.
6.2 Pay all traffic fines (50 AED admin fee per fine will be charged); and Salik tolls (AED 6 per pass) plus a 20 % administrative fee.
6.3 Maintain engine oil, coolant, and tyre pressure levels. Ignoring warning indicators may void insurance and make the Hirer fully liable.
6.4 Return the Vehicle with the same fuel level; otherwise pay 1.5 × the refuelling cost.
6.5 Smoking or vaping inside the Vehicle is prohibited; violation incurs an AED 1,000 fine.
6.6 Return the Vehicle clean and in good condition; cleaning fee AED 400 applies for stained interiors and AED 80 for unwashed return.
6.7: Mileage allowance: 200 KM/day, 1,200 KM/week, 3,500 KM/month – AED 1.00 per excess KM ; Unless otherwise specified in writing on page 1 of the agreement. 

 

Article 7 – Damage and Repairs

7.1 The Hirer shall not perform or authorise repairs without the Owner’s prior written consent.
7.2 Scratches, dents, or wheel damage from negligence are chargeable up to AED 750 per item.
7.3 Damage from overheating or neglect is fully chargeable to the Hirer, including replacement parts from authorised dealers.
7.4 All accidents must be reported immediately, and a valid police report must be obtained for any insurance claim.

 

Article 8 – Security Deposit

8.1 A refundable deposit of AED 1,500 or one month’s rent, whichever is higher, shall be blocked on the Hirer’s credit card or paid in cash.
8.2 The deposit will be released within 30 days after the Vehicle’s return, subject to any outstanding fines, damage, or outstanding payments.

8.3 The Hirer authorises Olive Tree Car Rental L.L.C. to securely store the payment card provided at the time of booking or vehicle handover for future charges related to the rental agreement. This includes, but is not limited to, traffic fines, damage repair costs, excess mileage, fuel discrepancies, or late return fees as per UAE regulations and applicable card-network rules.

 

Article 9 – Termination

9.1 The Owner may terminate and repossess the Vehicle if:
(a) Payment is overdue;
(b) The Hirer misuses the Vehicle or engages in illegal conduct;
(c) Two or more accidents or repeated violations occur.
9.2 No refund applies upon termination for the Hirer’s breach.

 

Article 10 – Governing Law and Jurisdiction

This Agreement is governed by the laws of the United Arab Emirates. The Courts of Dubai shall have exclusive jurisdiction over all disputes arising from this Agreement.

 

Article 11 – Miscellaneous Provisions

11.1 This Agreement supersedes all prior arrangements and understandings.
11.2 Notices shall be valid if sent to support@olivetreecars.com.
11.3 If any provision is found invalid, the remaining provisions shall remain in full force and effect.
